{"id":442,"date":"2019-09-13T14:41:37","date_gmt":"2019-09-13T14:41:37","guid":{"rendered":"https:\/\/nancypricelaw.com\/?page_id=442"},"modified":"2019-09-13T14:41:37","modified_gmt":"2019-09-13T14:41:37","slug":"practice-areas-details-2-2","status":"publish","type":"page","link":"https:\/\/nancypricelaw.com\/?page_id=442","title":{"rendered":"Federal Charges and Investigations"},"content":{"rendered":"<section class=\"kc-elm kc-css-261022 kc_row\"><div class=\"kc-row-container\"><div class=\"kc-wrap-columns\"><div class=\"kc-elm kc-css-799853 kc_col-sm-12 kc_column kc_col-sm-12\"><div class=\"kc-col-container\"><div class=\"kc-elm kc_text_block\"><\/p>\n<style type=\"text\/css\"><\/style>\n<section class=\"kc-elm kc-css-3400274 kc_row\">\n<div class=\"kc-row-container kc-container\">\n<div class=\"kc-wrap-columns\">\n<div class=\"kc-elm kc-css-4305701 kc_col-sm-12 kc_column kc_col-sm-12\">\n<div class=\"kc-col-container\">\n<section class=\"criminal-low\">\n<div class=\"container\">\n<div class=\"row\">\n<div class=\"col-md-6 col-sm-12 col-xs-12\">\n<div class=\"section-title\">\n\t\t\t\t\t<i class=\"flaticon-handcuffs\"><\/i><\/p>\n<h2>Federal Charges<\/h2>\n<\/div>\n<div class=\"content-text\">\n\t\t\t\t\t<strong>Federal Crimes are seriou<\/strong><strong>s and you need an experienced attorney to handle them<\/strong><strong>.<\/strong><\/p>\n<p>In federal court, judges must consider the &#8220;advisory guidelines\" in fashioning an appropriate sentence.\u00a0 The guidelines are complicated and require in-depth knowledge to correctly apply the calculations.\u00a0 After the facts of the case are applied to the law, a guideline range is reached.<\/p>\n<p>Federal Cases include a multitude of alleged crimes, but the general categories are:<\/p>\n<p><strong>Drugs:<\/strong> In federal court, drug charges are mostly limited to &#8220;trafficking\" type crimes &#8211; manufacture, growing, distribution, or possession with the intent to distribute, and conspiracy to commit any of these crimes.<\/p>\n<p><strong>Child pornography\/enticement:<\/strong> Federal jurisdiction can be had on these type of crimes if a computer, recorder, camera, film, disks, etc., was involved.\u00a0 As it is almost impossible for possession of child pornography to not involve one of these mediums, Federal jurisdiction is almost always possible if the US Attorney chooses to prosecute these crimes.<\/p>\n<p><strong>Fraud:<\/strong> In federal court, fraud centers in large part on the use of a bank, wire or the mail.\u00a0 Meaning, if any of these mediums was \u201cused,\u201d then a case may have federal jurisdiction.\u00a0 As it is essentially impossible to conduct business without the use of a bank, the mail or wire (phone, fax, computer, etc), most cases will fall under federal jurisdiction if the US Attorney chooses.\u00a0 Remember that criminal prosecutions can evolve from investigations by federal agencies &#8211; Department of Labor, EPA, IRS, Immigration, Medicaid\/Medicare and Social Security.\u00a0 These investigations can, and frequently do, escalate to criminal prosecutions.<\/p>\n<p><strong>Guns:\u00a0<\/strong> Federal charges are typically directed at firearm possession by &#8220;prohibited individuals.\"\u00a0 Prohibited persons include felons, persons subject to orders of protection, persons with domestic violence convictions (including misdemeanors), unlawful users of drugs and the mentally incompetent. Gun related charges are also filed when the prosecutor alleges the use of a firearm in relation to a drug crime or a crime of violence.<\/p>\n<p><strong>Obstruction:<\/strong>\u00a0 Lying to a federal agent, witness tampering, perjury, etc., are all types of federal obstruction of justice crimes.\u00a0\u00a0It is easy to misspeak to law enforcement.\u00a0 Agents rarely record interviews with\u00a0their &#8220;subjects.\"\u00a0 When you speak with a federal agent, your\u00a0statements could be misinterpreted and the agent could conclude you have lied to her.\u00a0 If they do, that\u00a0constitutes a federal crime, a felony.\u00a0 ALWAYS REMEMBER, YOU HAVE THE RIGHT TO CONSULT WITH AN ATTORNEY BEFORE SPEAKING WITH AUTHORITIES.<\/p>\n<p><strong>Immigration:<\/strong> These cases generally target employers alleged to illegally hire or harbor illegal aliens or target the immigrant himself for illegal entry or reentry to the United States.\t\t\t\t<\/div>\n<\/div>\n<div class=\"col-md-6 col-sm-12 col-xs-12\">\n<figure>\n\t\t\t\t\t<img src=\"https:\/\/nancypricelaw.com\/wp-content\/uploads\/2017\/11\/1-9.jpg\" alt=\"\"><br \/>\n\t\t\t\t<\/figure>\n<\/div>\n<\/div>\n<\/div>\n<\/section>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/section>\n<section class=\"kc-elm kc-css-94790 kc_row\">\n<div class=\"kc-row-container kc-container\">\n<div class=\"kc-wrap-columns\">\n<div class=\"kc-elm kc-css-4043575 kc_col-sm-12 kc_column kc_col-sm-12\">\n<div class=\"kc-col-container\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/section>\n<p>\n<\/div><\/div><\/div><\/div><\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":1,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"tpl-visual_composer.php","meta":[],"_links":{"self":[{"href":"https:\/\/nancypricelaw.com\/index.php?rest_route=\/wp\/v2\/pages\/442"}],"collection":[{"href":"https:\/\/nancypricelaw.com\/index.php?rest_route=\/wp\/v2\/pages"}],"about":[{"href":"https:\/\/nancypricelaw.com\/index.php?rest_route=\/wp\/v2\/types\/page"}],"author":[{"embeddable":true,"href":"https:\/\/nancypricelaw.com\/index.php?rest_route=\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/nancypricelaw.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=442"}],"version-history":[{"count":3,"href":"https:\/\/nancypricelaw.com\/index.php?rest_route=\/wp\/v2\/pages\/442\/revisions"}],"predecessor-version":[{"id":498,"href":"https:\/\/nancypricelaw.com\/index.php?rest_route=\/wp\/v2\/pages\/442\/revisions\/498"}],"wp:attachment":[{"href":"https:\/\/nancypricelaw.com\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=442"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
